Ma & Pa’s Seasonal Reservation/Lease Agreement

Thank you for choosing Ma & Pa’s Cabin & Sleigh Rides Llc.. Please review the information, rules, terms and conditions within this agreement. Once this agreement has been reviewed and all terms and conditions approved, please sign this confirmation and return it to us. If you are renting the unit sight unseen, your signature and/or agreement email shall operate to release Ma & Pa’s Cabin & Sleigh RIdes Llc. and its representatives from any and all claims for damages or losses related to any alleged defects, conditions or deficiencies that may exist in the unit. This Seasonal Reservation & Lease Agreement is intended to be a legal and binding contract. Phone or Internet reservations are only accepted with a valid credit card. We do not accept reservations or cancellations through email.

Seasonal & Short Term Rental Rules, Regulations & Disclosures

Check -In: Check in time is any time after 3:00 PM. Upon arrival we will meet you at the property/Cabin or arrangements will be made as to where the key will be located.

Guests will need a valid drivers license and credit card and photo I.D..

Check-Out: Check out time is any time before 11:00 AM. Tenant shall be liable for any damages including, but not limited to, lost rents, as a result of late check out.

Payment: Payment must be made in full before your arrival date. Plus any security deposits will be required as the discretion of the Owner and will be required before keys and possession of the unit is provided to the Tenant(s).

Refundable Security Deposit: Security Deposit required to book at the Owners discretion and will be refunded after a walk through of the unit is completed after the Tenant(s) departure.

Occupants: Only those occupants named in this agreement as Tenant(s) shall occupy the unit unless written consent of the Owner is obtained.

Pets: We do not allow any type of Pets of any kind, except those that are ADA Compliant. Proper paperwork required. Tenant(s) may be charged a pet fee or a refundable pet deposit.

Smoking/Hunting/Open Burning/3 or 4 Wheelers/Pond/Parties: Smoking is strictly prohibited in the unit and any decks or adjacent areas to the unit. Please smoke in the driveway near your vehicle. Any damages will be billed and paid by the Tenant(s).

Guests who violate the smoking policy agree to pay a $250 Cleaning Fee to cover dry cleaning draperies and bedding as well as carpet cleaning.

Pond Liability: Tenant(s) acknowledge that they are aware of the pond in front of the said Cabin. Accommodations are not conducive to children under the age of 18 years old and younger, or those of the staying/renting of invitees or guests at this unit/Cabin. A life preserve is on site and located by the pond. Watch your kids, we are not liable if they go into the pond for any reason, that goes for Adults also.

All of the above is prohibited, No Swimming, Ice Skating, Fishing, or Canoeing on the Pond! If any of the above is found you will be asked to leave, no refunds!

Cancellation Terms: Tenant(s) may cancel this agreement and pay a fee based on when they cancel.

5 Days Prior to Arrival: Free Cancellation

After 72 Hours we reserve the right to charge your card on file for a one night stay. ($159).

Miscellaneous Charges: Tenant(s) shall be assessed additional locksmith charges. If any, for each key, not returned to the Owner upon check out. Such charges will be deducted from the deposit. Tenant(s) agrees to pay Owner $35 in the event of a lock out and if the key is not returned the Tenant(s) will be charged to change the locks and door knobs. If ANY damages are incurred by the Tenant(s) to the unit’s interior, exterior, any furnishings, dishes, appliances, septic system, grill, patio furniture, fireplace, firepit, or anything by the Owner, the Tenant(s) will be responsible for fixing said damages. If the damages exceed the security deposit, the said Tenant(s) shall pay for any repairs or damages. Normal wear and tear is excluded.

Assignment: Tenant(s) shall not assign this agreement or sublet the premises of any part thereof. Any unauthorized transfer of interest by the Tenant(s) shall be a material breach of this agreement.

Indemnification: Tenant(s) agree to indemnify and hold harmless Owner and their representatives and employees from claims, suits, or damages of any kind (including damages for personal injuries), or Acts of God, in any way arising out of or related to any acts or omissions of Tenant(s) or Tenant(s) guests or invitees.

Tenant(s) agree to indemnify and hold Owner and its employees and representatives harmless from damages and losses of any kind (including damages for personal injury) arising out of or relating to Tenant(s) occupancy of the property, including damages and losses arising from Owner’s negligence.

Risk of Loss: Personal property of Tenant(s) and Tenant(s) invitees or guests shall be at the sole risk of the Tenant(s). The Owner shall not be liable for any damage caused to Tenant(s) or any invitees or guests personal property arising from fire, acts of God, criminal acts, acts of Owner’s negligence, or bursting or leaking water pipes.

Governing Law, Venue & Waiver of Jury Trial: Ohio Law shall govern any dispute arising out of or in any way relating to Tenant(s) rental of the unit of the relationship between Tenant(s), Owner. Venue for any litigation or any other proceeding involving Owner, its employees or its representatives shall be exclusively in the state courts of Geauga County, Ohio with Owner, Tenant(s) waiving any claims or defenses based on an inconvenient forum. ALL PARTIES TO THIS AGREEMENT KNOWINGLY AND VOLUNTARILY AGREE TO WAIVE ANY RIGHT TO TRIAL BY JURY IN ANY LITIGATION.

Tenant(s) signatures below signify their acknowledgement and agreement of all terms on this Seasonal Reservation Lease Agreement as well as receipt and agreement with the Seasonal Short Term Rental Rules, Regulations and Disclosures attached and incorporated herein. These documents are intended to be a legally binding contract. If you do not fully understand any portion, consult an attorney prior to signing. If you are not reserving by phone you are agreeing to this document and will be asked to sign it when you arrive for check in.
